Trinidad Consolidation

BNSF IMPLEMENTING AGREEMENT NO. 19

 

 

between

 

 

THE BURLINGTON NORTHERN AND SANTA FE RAILWAY COMPANY

 

 

and

 

 

UNITED TRANSPORTATION UNION

 

 

The purpose of this agreement is to provide for expedited changes in services, facilities, operations, seniority districts and existing collective bargaining agreements to effectuate the common control approved by the I. C. C. in Finance Docket No. 32549.  The purpose, is also to enable the company to be created by consummation of the merger proposed in that Finance Docket to be immediately operated in the most efficient manner as one completely integrated railroad.

 

 

This Implementing Agreement, therefore, is made in accordance with a Notice served by the company on August 17, 1999 to consolidate the Trinidad, Colorado terminal.

 

 

IT IS AGREED:

 

 

Article I - Consolidation-of Trinidad Terminal

 

 

Section 1.

 

 

A.   The present terminal and switching limits of the former Colorado and Southern Railway Company (C&S), a predecessor railroad of Burlington Northern (BN), and Santa Fe (SF) at Trinidad will be consolidated.  The new switching limits for the consolidated yard at Trinidad are:

 

 

            BN line to Pueblo       Milepost 206.28

 

            BN line to Texline       Milepost 215.40

 

            SF line to Raton          Milepost 639.0

 

            SF line to LaJunta       Milepost 635.0

 

 

B.    Road-Yard Service Zones, as they existed on September 21, 1995, are neither contracted nor expanded by this agreement, but any yard crew, without regard to predecessor road affiliation, can do any permissible work in such zones.

 

 

Section 2.

 

 

A.   Train crews may be required to perform the same work throughout this consolidated terminal, including delivery and receiving of cars or trains, as they may perform, under applicable collective bargaining agreements in their present separate terminals.

 

 

B.    In situations where switching activities performed outside of switching limits are necessary, such service may be assigned to any yardman based or working in the consolidated terminal.

 

 

C.    C&S's collective-bargaining agreement (except as modified here) will apply to yard assignments established at Trinidad

 

 

D.   If one or more yard assignments are established in the Trinidad consolidated terminal, the parties will meet to discuss an equity arrangement between former BN (C&S) and ATSF yardmen represented by the United Transportation Union.

 

 

E.    A joint study will be conducted of the switching at Trinidad, if it indicates there is an average of more than four (4) hours switching by road crews, within 10 hours for seven consecutive days, a switching assignment will be reestablished.

 

F.    In case the Carrier desires to abolish the switching assignment in Trinidad Yard, the procedure outlined in Section E will be followed.  For re-establishment of the assignment the principles outlined in Section E will apply.

 

G.    Upon implementation of this agreement a utility yardman assignment will be established around the clock at Trinidad to assist road crews. 

 

Article II - General

 

 

A.   All pre-existing agreements that conflict with the terms of this agreement are superseded to the extent of the conflict.

 

 

B.      This implementing agreement is made pursuant to the New York Dock Conditions (Finance Docket No. 28250) which, by this reference, are incorporated herein.

 

 

C.      Nothing in this implementing agreement shall be interpreted to expand or contract protective benefits provided in the New York Dock Conditions imposed by the Interstate Commerce Commission and incorporated here by paragraph B of this Article.

 

 

D.      This agreement will become effective immediately upon the signing of the accepted date as noted below.  It may be later changed by mutual agreement or in accord with applicable law.
